Regulation (EU) 2019/1148 on the marketing and use of explosives precursors

Regulation (EU) 2019/1148 on the marketing and use of explosives precursors, establishes rules around the making available, introduction, possession and use of mixtures with the intention of minimising the illegal use of substances or mixtures, and to establish a reporting system of suspicious activity throughout the supply chain. This Regulation comes into effect from 1st February 2021.

This Regulation does not apply to:

  • Objects which during production are given a special shape, surface or design which determines its function to a greater degree than its chemical composition;
  • Articles containing explosive substances or an explosive mixture of substances;
  • Percussion caps for use in toys; or
  • Medicinal products made available through a medical prescription.

Duties are placed on Economic Operators and Professional Users in relation to the following:

  • Licencing;
  • Verification;
  • Reporting; and
  • Training

As a consequence of this Regulation, an amendment is made to Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH). The amendment makes changes to Annex XVII of REACH, removing the security restrictions on Ammonium nitrate, as the restrictions now sit within Regulation 2019/1148.
