Summary

The Secretary of State is given the power to create regulations covering the marketing and use of products to:
  • reduce or mitigate health and safety risks from products;
  • ensure products operate efficiently or effectively; and
  • ensure products designed for weighing or measuring are accurate.

Regulations created under the Act can set the marketing and use requirements of products for those involved in the supply chain in the United Kingdom. The regulations may set out:
  • technical standards which a product must meet;
  • quantities and units in which goods must or may be marketed;
  • requirements for the marking or packaging of goods;
  • action to take in the event of emergency;
  • powers for enforcement authorities and inspectors;
  • information which must be disclosed to authorities;
  • fees which may be charged by authorities; and
  • requirements to comply with existing product and metrology legislation.
