10 June 2021

Amends/Commences:

  • The Greenhouse Gas Emissions Trading Scheme Regulations 2012

  • Environment Act 1995

  • Greenhouse Gas Emissions Trading Scheme (Amendment) and National Emissions Inventory Regulations 2005

Comes into force: 1st May 2021

Jurisdiction: UK

The Greenhouse Gas Emissions Trading Scheme Regulations 2012:
Regulation (EU) No 389/2013 establishing a Union Registry pursuant to Directive 2003/87/EC has been amended to allow the UK to operate a domestic UK Registry separate to the EU CSEUR. As a result, any provisions relating to the UK Registry have been moved to the retained Registry Regulation.

Environment Act 1995:
The Environment Act 1995 is amended to provide charging authorities with the ability to make charges in relation to the UK Kyoto Protocol Registry.

Following the UK's exit from the EU, the UK now has its own domestic national registry (the UK Kyoto Protocol Registry) and therefore requires the associated charging powers which this Act provides.

Greenhouse Gas Emissions Trading Scheme (Amendment) and National Emissions Inventory Regulations 2005:
The Environment Agency is no longer required to take account of EU laws when considering applications for Kyoto Protocol projects as the UK is no longer part of the EU. Instead, it must ensure that the UK’s relevant international climate law obligations are satisfied.
