The Chemicals (Health and Safety) Trade and Miscellaneous Amendments Regulations 2022

Amends/Commences: 

  • GB Retained: Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures;

  • GB Retained: Regulation (EU) No 649/2012 concerning the export and import of hazardous chemicals;

  • GB Retained: Regulation (EU) No 528/2012 concerning the making available on the market and use of biocidal products;

  • Biocidal Product and Chemicals (Appointed of Authorities and Enforcement) Regulations 2013; and

  • The Health and Safety Nuclear (Fees) Regulations 2021.

Comes into force: 1st November 2022

These Regulations create an information sharing gateway that enables the Health and Safety Executive (HSE) to share information. This is to facilitate provisions contained in the trade agreement between the UK, Iceland, Liechtenstein, and Norway (EEA/EFTA countries*).

*The 3 EFTA countries are linked to EU Member States to form an internal market that enables the free movement of people, goods, services, and capital.

Technical changes are also made to address deficiencies in retained EU legislation, relating to chemicals. These deficiencies arose from the withdrawal of the UK from the European Union (EU).
