The Agency Workers Regulations 2019

The 'Swedish Derogation*' contract is being revoked due to abuse of the system.

Previously, agency workers could waive their rights to the same pay as a permanent employee after 12 weeks if they signed a “pay between assignments” contract.

Organisations will still be able to offer between assignments contracts to agency workers after revocation, but workers will not be able to opt out of equal pay entitlements after 12 weeks in the same role with the same hirer.

*The Swedish Derogation means a pay between assignments contract.
